COLLECT THEIR INFORMATION
If someone you love is facing deportation, the first thing that you should do is collect as much of their information as possible. This is going to make everything go smoothly once you contact your immigration attorney. If you can’t find some of this information, your attorney may be able to help, but it’s best to have as much information as possible before you contact your immigration lawyer. The information should include:
- Full name of the accused and any aliases
- Immigration status
- Alien registration number
- Where they are being held
- The immigration court date
- A copy of your loved one’s NTA
If it is possible for you to get a copy of their Notice to Appear or NTA that will have further information that can be incredibly useful for your attorney. The NTA will include any charges that your loved one is being accused of and list hearing dates.
HIRE AN IMMIGRATION ATTORNEY
Once you have gathered any information that you can about your loved one, it’s time to contact an experienced immigration attorney. You want to ensure that the attorney you hire has extensive experience in not just immigration law, but also in deportation hearings. Deportation and removal proceedings can be complicated and the cards may already be stacked against you, so it’s important to have someone on your side who knows the system.
TYPES OF DEPORTATION HEARINGS
There are several different types of hearings that your loved one will go through when they are facing deportation. Understanding each type of hearing will help you help your loved one.
The Bond Hearing
The bond hearing is simply to decide if your loved one will have a bail amount set for their release until their court date. The court may decide that they are not a flight risk and could even release your loved one on their own recognizance without having to post bail or a bond.
The Master Calendar Hearing
This hearing date will be the one listed on the NTA. This is mostly for administrative purposes. This is when you will find out what your loved one’s options are and the judge will schedule a date for the individual hearing. Your loved one will not be asked any details of their case and no witnesses will be called during the Master Calendar Hearing.
The Individual or Merits Hearing
This is the hearing where your loved one’s case will be heard and decided upon. Your loved one and their immigration lawyer will present evidence and testimony for their case.
